For every claim, we handle all communications with your insurer. You won’t have to speak with them while we represent you! For Life Insurance Clients:
Life insurance claims may be denied for a number of reasons. The insurance company may claim that coverage had lapsed before your loved one died, or that a certain policy provision excludes coverage. Alternatively, another person may be claiming to be the beneficiary under the policy due to the insured’s divorce and remarriage. Many other reasons can cause denials. But the insurance company is often wrong. We dig into the true facts, the stated reason for the denial, and the details of the policy language. Most importantly, we review the special regulations and court interpretations that apply to your case to determine every possible reason the insurance company is wrong and that you are entitled to the benefits.
For Accidental Death and Dismemberment Insurance Clients:
Accidental death and dismemberment claims can be denied for many reasons. One of the most common reasons for the denials that we successfully fight include denials where the insurer claims that a death was not accidental, but rather, was due to “natural” causes, or illness, sickness or disease. Another is when the insurer claims a certain policy exclusion applies, such as intoxication, or drug overdose. We see many other reasons for claim denials that we can fight. As with life insurance claims, we begin by digging into the true facts, the stated reason for the denial, and the details of the policy language. We often need to hire outside physician experts to help us dispute the insurers’ reasons for denying the claim. We then review the special regulations and court interpretations that apply to your case to determine every possible reason the insurance company is wrong, and that you are entitled to the benefits.
For Long Term Disability Insurance Clients:
Our team studies your denial letter and policy before diving into nationwide Federal Court case law and all applicable regulations to create a strategic plan for your claim. We review your entire claim file to create a master summary for your claim which will identify key missing evidence needed to strengthen your case and prove you are qualified for the insurance benefits you paid for. We then request and prepare the necessary evidence (medical records, physician notes, and more) to ensure you have the best chance of being approved for your benefits.
For ERISA Insurance Claims Clients:
If your long term disability, accidental death and dismemberment, or life insurance claim involves an insurance policy issued by your employer, then federal ERISA law applies to your case. ERISA stands for Employee Retirement Income Security Act of 1972. Under this law, a different set of complex federal regulations apply to the claim process, and all lawsuits for ERISA-governed claim denials must be filed in federal court. Once in federal court, ERISA cases follow a different process than any other type of civil case. While very few attorneys handle ERISA cases, we’ve been specializing in these claims for decades.

Our fee is earned and our advanced litigation costs are recovered only when we recover for you by settlement or trial judgment. Our clients owe us nothing, no fee and no reimbursement of our advanced litigation costs, no matter how large, unless we recover.
