Our past years of representing insurance companies taught us a thing or two about how they work behind the scenes. Let our experience work for you.

UNUM Disability Lawsuit in Texas

Helping Individuals in Texas with Filing a UNUM Disability Lawsuit

If you are insured by UNUM through your employer, your insurance plan is most likely covered under the Employee Retirement Income Security Act of 1974, otherwise known as ERISA.

ERISA is a federal statute that was enacted by Congress in 1974, in order to safeguard employee benefits and help ensure that they receive these benefits when they need them. Unfortunately, employer-sponsored insurance plans do not always work that way, and insurance companies actually have an incentive to deny employees their much-needed benefits.

If you have been denied disability benefits under your employer-sponsored plan of insurance, you must complete certain prerequisites prior to filing a UNUM disability lawsuit in Texas. At the Law Offices of J. Price McNamara, we can help you take the necessary legal steps to pursue the disability benefits that you deserve. Please contact us online today for more information and to schedule a free case evaluation and legal consultation.

Review Your Denial Letter Thoroughly

If your claim for disability benefits has been denied by the insurance company, the first step that you should take is to review your claim denial letter very carefully. The denial letter will set forth exactly why your claim for disability benefits was denied.

In some instances, you may have failed to follow some protocol established by the insurance company, and consequently, they have denied you benefits. In other cases, you may not have submitted the necessary documentation to support your claim for long-term disability benefits. Remember, to be eligible for these benefits, you need to show that you suffer from a permanent disability that keeps you from working.

An experienced attorney can review the denial letter with you and determine what actions you need to take on administrative appeal.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Appealing a Claim Denial

There are several steps that you need to take if you are interested in appealing a disability claim denial. Unfortunately, you cannot file a UNUM disability lawsuit in Texas right away. First, you must exhaust all of the insurance company’s administrative appeal opportunities. Your denial letter will set forth exactly what you have to do in order to administratively appeal your benefits denial. You should follow this protocol closely because if you fail to follow it, your claim for benefits will most likely be denied for a second time.

Litigating a Claim Denial by Filing a Lawsuit

Once you have exhausted any and all administrative appeal remedies presented by the insurance company – and if you still do not have the disability benefits you need – then you may file a lawsuit against your insurance company in the court system.

Due to the ERISA statute, insurance companies have significant advantages in federal court. One of the most important advantages is that in the federal system, you are not entitled to a trial by jury. Rather, a judge must decide the issue of whether or not you are entitled to disability benefits. Consequently, it is important that you have an experienced lawyer by your side in federal court.
