About J. Price McNamara

Price McNamara began his law practice in 1990 representing insurance companies.

In 1995, Mr. McNamara founded McNamara Law Offices, where he represents people across the U.S. who are wrongfully denied long-term disability insurance, life insurance, and accidental death insurance benefits, with special focus on ERISA claims and lawsuits.

Defining ‘Material Factual Misrepresentations’ on a Life Insurance Policy Application

Whenever an insured decides to pursue life insurance benefits, he or she must fill out an application. On the application, the prospective insured must provide a great deal of personal information, including the insured’s weight, age, height, medical condition, and any preexisting illnesses or medical conditions. The insurance company will then review the application package and decide whether or not to afford the insured coverage. 

The definition of ‘material factual misrepresentation’ varies from insurance company to insurance company. The insurance company may decide to deny a claim based upon a material factual misrepresentation made on an application for benefits. Such material factual misrepresentations may include one or more of the following:

  • That the insured lied about his or her medical condition at the time of filing the application
  • That the insured deliberately failed to disclose a preexisting medical condition or illness at the time he or she filed the application
