Why are Claims Denied?

Insurance companies can deny claims for long-term disability benefits for several different reasons. You should keep in mind that insurance companies have a very strong incentive to deny you benefits -– especially if the federal ERISA statute controls your employer-sponsored plan. Insurance companies are in the business of making money, and they obtain this money by charging their customers premiums. Insurance companies do not make money, however, when they are paying out disability claims.

First, the insurance company may allege that you did not attach sufficient medical documentation to support your need for disability benefits. The medical documentation included must indicate that you are currently suffering from a major injury or illness, that you are disabled, and that your disability does not allow you to work in any capacity. Moreover, this opinion must be stated by a medical provider to a reasonable degree of medical certainty.

When can I file a Disability Lawsuit?

Unfortunately, you are not able to file a lawsuit against your insurance company as soon as your claim for disability benefits is denied. Rather, there is a certain internal protocol that you must first follow. You are required to exhaust all of the administrative remedies which are available through your insurance company. At this administrative level, you must also make sure to supplement the record with any necessary medical evidence or other documentation necessary to support your claim for disability benefits. If you do not include this documentation, and the case goes to federal court, you will not be able to introduce documentation at that time.

Once you are finished with all of the administrative remedies, if you still do not have your disability benefits, you might be able to file a disability lawsuit directly against your insurance company. This lawsuit must be filed in federal court. Once the lawsuit is filed, the discovery phase will happen, along with a hearing.

At the hearing, a federal judge will reach a decision about whether or not to grant you disability benefits. At the federal hearing, you will not have a right to trial by jury. Moreover, even if you feel that the insurance company wrongfully denied your disability benefits at the administrative level, you will not be able to file a claim against them for bad faith in the federal court system.
