The Definition of an ‘Accident’

Different insurance companies define the term ‘accident’ in different ways. Virtually all insurance policies contain a definitions section, in which various terms that are used throughout the policy are defined. In order for a death to be considered accidental, there must not typically be intentional or deliberate conduct involved on the part of the insured. For example, true accidents under an insurance policy are usually slip and fall occurrences, drowning and boating accidents, and motor vehicle collisions. 

When a beneficiary claims that an accidental death occurred within two years or less of the insured taking out the policy, the insurance company will usually undertake a thorough investigation of the circumstances leading up to the insured’s death. Deaths that occurred because of suicide or some other type of self-inflicted injury will not usually be covered under an accidental death policy. If the beneficiary makes a claim in one of these instances, it is extremely likely that the insurance company will deny the claim. The same holds true if the insured had a preexisting injury or medical condition that led to his or her untimely passing, and this was not timely disclosed to the insurance company. 

Appealing an Accidental Death Claim

If you are a named beneficiary under an accidental death policy and the insurance company has issued a claim denial in your case, you may be able to file an administrative appeal of that denial with your insurance company. 

If the insurance company denies your administrative appeal(s), you may then have the option of appealing your case to federal court – especially if the plan was an employer-sponsored plan that was covered under the Employee Retirement Income Security Act of 1974 (ERISA).
