Texas Accidental Death Insurance Attorney

Helping Texas Residents Pursue the Accidental Death Insurance Benefits They Deserve

In theory, the purpose of accidental death benefits is to compensate a designated beneficiary in the event the policyholder passes away unexpectedly due to accidental death. Whenever the insured policyholder passes away under these circumstances, the beneficiary should be able to make a claim under the policy.

All too often, however, insurance companies deny these claims for accidental death benefits. There are many reasons why the insurance company might deny the claim, but whatever the case, by denying the claim, the insurance company is saving itself a significant amount of money. Insurance companies do not make money by paying out claims for accidental death benefits. Rather, they make and keep their money by collecting policyholder premiums.

If you are the beneficiary under an accidental death insurance policy and you have been denied benefits, it is extremely important that you speak with a Texas accidental death insurance attorney as soon as possible at the Law Offices of J. Price McNamara. Please reach out to us today to learn more about how we can assist you with your legal matter and advocate for your interests.

Defining an Accidental Death

The specific circumstances that are considered accidental deaths under a particular insurance policy are typically found in the definitions section of the policy. In most cases, in order for a death to be considered accidental, it must be unexpected. Most insurance policies consider a death to be accidental if the insured dies in a motor vehicle collision, boating accident, slip and fall, or other similar circumstances.

In order to determine whether or not your loved one’s death is an accidental death, you should consult the specific language of the insurance policy at issue.

Most insurance policies also contain an exclusions section. As it pertains to accidental death benefits, there are usually certain circumstances where the insurance company will not consider a particular death to be accidental. Such is the case where the insured contributes to his or her own death or commits suicide. Again, you should consult the exclusions section of the insurance policy to see if a particular death circumstance is excluded from coverage under the policy.

Making a Claim for Accidental Death Benefits or Appealing a Claim Denial

If you are the beneficiary under an accidental death policy, and you believe that the circumstances behind your loved one’s death were accidental, you should make a claim against the policy for a payout. When you make your claim, it is extremely important that you follow all of the protocols established by your insurance company. For example, you may need to provide a copy of the death certificate, police report, or other similar documentation.

If you do not provide the proper documentation, it is very likely that your accidental death claim will be denied.

In the event your insurance company denies the claim, you may have the option of filing an administrative appeal. An administrative appeal is an appeal that is filed directly with your insurance company for an internal review. Your insurance company will consider any additional documentation that you provide and will then make a decision.

Once you have exhausted all of the administrative options, and if your claim is still denied, you may be able to pursue federal litigation against your insurance company in the court system. A Texas accidental death insurance attorney can review all of your appeal options with you and help you decide on the best course of action for your particular case.

Our number-one goal is getting you and your family back to financial security as soon as possible.
