Who is Required to Abide by ERISA Laws?

These protective laws only apply to employers that are private and non-government who offer health insurance coverage and other benefit plans through their employer to the employees. ERISA does not require employers to offer such plans or benefits for health, retirement, or other benefits. These laws only set minimum standards, or rules, for some types of benefits that an employer may choose to offer their employees.

ERISA does have some limitations and exemptions and is a complicated area of law. If you need to pursue a claim against an ERISA employer, the laws will offer you some protection if you have been wronged due to financial mismanagement of benefits or plans.
