Long Term Disability / Life /
Accidental Death / ERISA

Our past years of representing insurance companies taught us a thing or two about how they work behind the scenes. Let our experience work for you.

Shreveport ERISA Attorney

Employee Retirement Income Security Act of 1974 is also known as ERISA and is a federal law that applies to most, but not all, private employers. The law establishes a minimum standard for retirement plans, health, and other benefits such as life and disability insurance. It does not require an employer to offer these benefits but protects employees and their employers if they do.

Who is the Administrator of ERISA?

ERISA is controlled by a division of the Department of Labor called the Employee Benefits Security Administration. Any complaints, questions, or concerns about ERISA can likely be started by contacting the local DOL office, but an experienced Shreveport ERISA claims attorney can also help you with these issues and other legal matters surrounding ERISA law. Additional matters that you might need to discuss with an attorney include, but are not limited to, the following:

  • Claims for breach of fiduciary duty against ERISA fiduciaries for self-dealing or violation of the terms of a pension plan.
  • Defense claims seeking disability benefits through employer-sponsored plans.
  • Disputes regarding ERISA exemptions during the application process.
  • Medical insurance claims that have been denied as experimental or not medically necessary.
  • Disputes over which plan is primary versus secondary.
  • Disputes regarding whether a benefit plan is compliant with ERISA laws.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Who is Required to Abide by ERISA Laws?

These protective laws only apply to employers that are private and non-government who offer health insurance coverage and other benefit plans through their employer to the employees. ERISA does not require employers to offer such plans or benefits for health, retirement, or other benefits. These laws only set minimum standards, or rules, for some types of benefits that an employer may choose to offer their employees.

ERISA does have some limitations and exemptions and is a complicated area of law. If you need to pursue a claim against an ERISA employer, the laws will offer you some protection if you have been wronged due to financial mismanagement of benefits or plans. However, it is almost always advisable to seek the assistance of an experienced ERISA attorney rather than attempting to handle such complex areas of law on your own.
