About J. Price McNamara

Why are Disability Claims Denied in the First Place?

Claims for disability benefits are denied for a variety of reasons. In some instances, the insurance company might deny the claim because it was not filed in a timely manner or because the claimant did not follow the proper protocol. 

More likely, though, the insurance company will deny the claim because of a lack of sufficient medical documentation. Essentially, in order to prove that you are disabled, you must have medical documentation that shows that you suffer from a permanent disability and that this permanent disability prohibits you from working.

Prerequisites to Filing a Lawsuit

Prior to filing a lawsuit against the insurance company, there are certain steps that you have to take. First, you must exhaust every available administrative remedy. This means that you must go through your insurance company’s appeal process, allowing the insurance company to either give you benefits or deny your benefits.

When you appeal your benefits denial administratively, you have the opportunity to include additional medical documentation from a healthcare provider that establishes that you are permanently disabled and that you are completely unable to work. It is important that you introduce this additional documentation at the administrative level because once a lawsuit is filed and the matter reaches the federal court system, you will not be allowed to supplement the administrative record with new documentation.
