Long Term Disability / Life /
Accidental Death / ERISA

Our past years of representing insurance companies taught us a thing or two about how they work behind the scenes. Let our experience work for you.

Macon Long Term Disability Lawyer

Most employer-provided disability plans are governed by the Employee Retirement Income Security Act (ERISA), while the employer pays the insurance premiums for the coverage. These policies are designed to provide benefits to cover a number of conditions, including but not limited to cancer, degenerative diseases, mental disorders, etc., incurred both on and off the job.

Too much is at stake to guess about the best approach and strategy for fighting your denied insurance claim — years and years of financial security.

After spending years representing insurance companies, we don’t guess. We know their playbook and how they work behind the scenes. Using that knowledge, we’ve developed our own Clear Advantage Process for fighting claims.

It’s personally satisfying to use what I’ve learned as an insurance company insider, now for the good — helping families reverse unfair denials of insurance benefits they paid for, need and deserve.

However, insurance companies frequently craft these policies to have tricky loopholes, such as defining disability in such a way as to halt one’s benefits after 12 to 24 months. This is why working with an attorney in order to ensure that you have submitted an application that has the right medical documentation and reflects an understanding of your individual policy is absolutely imperative in order to ensure that you are protected for the length of time that you need regarding your disability. What Does ERISA do, Exactly?

ERISA provides claimants with certain rights and requirements, such as:

  • The right to receive copies of any and all information related to your claim;
  • The right to appeal an adverse decision (ERISA provides you with at least 180 days to appeal, but it must be done within this timeframe);
  • The insurance company must make a decision on your appeal within 45 days of receiving it, unless special circumstances are needed, in which case it must notify the claimant and make a determination after no more than 90 days total; and
  • Claimants cannot be required to submit more than two appeals internally before bringing an action in court.

The federal ERISA law preempts state law, and this means that there are no bad faith/punitive damages available if you have to bring suit. Under ERISA, you can recover the benefits you are due, as well as interests, costs, and attorney’s fees. ERISA does mandate that the insurance company conduct a “full and fair review.”
