What Does ERISA do, Exactly?

ERISA provides claimants with certain rights and requirements, such as:

  • The right to receive copies of any and all information related to your claim;
  • The right to appeal an adverse decision (ERISA provides you with at least 180 days to appeal, but it must be done within this timeframe);
  • The insurance company must make a decision on your appeal within 45 days of receiving it, unless special circumstances are needed, in which case it must notify the claimant and make a determination after no more than 90 days total; and
  • Claimants cannot be required to submit more than two appeals internally before bringing an action in court.

The federal ERISA law preempts state law, and this means that there are no bad faith/punitive damages available if you have to bring suit. Under ERISA, you can recover the benefits you are due, as well as interests, costs, and attorney’s fees. ERISA does mandate that the insurance company conduct a “full and fair review.”
