Requirements for Obtaining Long-Term Disability Insurance Benefits

In order for you to be eligible to recover long-term disability benefits under an ERISA plan, there are certain requirements that you need to satisfy. First, you must currently be suffering from an injury or illness that is long-term or permanent in nature. Secondly, that long-term injury or illness must prevent you from working in any capacity. 

In order to demonstrate that your illness or injury wholly prevents you from working, you must have a health care provider on board who is willing to state that and document it in a written medical record. If your file lacks sufficient medical documentation, it is very likely that you will be denied long-term disability benefits – at least initially.

If your claim for disability benefits is denied, you have several legal options. The first option is to administratively appeal the denial with your insurance company. At this juncture, you have the opportunity of supplementing your medical record with additional documentation from your physician. 

When you are filing an administrative appeal of a long-term disability denial, it is essential that you follow all of the instructions and timelines referenced in the denial letter supplied by your insurance company. If you fail to follow these instructions, the insurance company is sure to deny your claim again.
