Claim Eligibility Requirements

For you to be eligible to file a claim for long-term disability, you must suffer from a long term injury or illness that prevents you from working. Your disability must be evident in the medical records which are presented as part of your claim, including doctor reports, imaging studies, and other pertinent documentation. If the necessary records are not included, the insurance company will not hesitate to deny your claim. 

Moreover, the medical records in your file should include information about any specific impairment from which you suffer, as well as any special limitations you have, including limitations that impact your daily living.

Appealing a Denial of Your Claim

If the insurance company denies your disability benefits application, you may be eligible to file an appeal of that decision. You could appeal the adverse decision one or two times, depending upon the language in the insurance policy. Moreover, you must be provided with at least 60 days to file your appeal, although some insurance policies provide for a longer time period. 

In determining what you should include as part of your appeal package, you should refer to the denial letter which your insurance company sent you. That document should include information about your appeal rights, time periods, and the documentation you must include to increase your chances of being successful on appeal. If you are not successful after appealing a claim denial, you might be able to file a lawsuit against your insurance company in federal court.
