There are several requirements that you must satisfy in order for you to be eligible to receive benefits for a long term disability. The most important requirement is that you must actually be suffering from a long-term disability at the time you apply for the benefits.

Applying for the Benefits You Deserve

The first step to recovering long term disability benefits is to fill out an application package and attach all of the required medical documentation. You must also make sure that you follow your insurance company’s protocols when it comes to filing and submitting the application. Otherwise, the application will likely be returned to you for resubmission.

It is also important to keep in mind that insurance companies often deny first-time applications for long-term disability benefits. These applications are denied for a variety of different reasons. In the majority of cases, applications are denied because applicants fail to follow the required procedures and protocols during the application process and/or do not include the necessary and required medical documentation.

The denial letter which the insurance company sends out will state exactly what the applicant needs to do in order to administratively appeal the denial decision. The letter will also state the time deadline by which the administrative appeal must be filed. Once the appeal documentation is received, the insurance company will review the application again and make a decision on benefits. Some insurance companies allow a second round of administrative appeals. However, if your insurance company does not allow that, you may have the option of suing your insurance company in federal court.

If you sue your insurance company in federal court, the insurance company becomes the defendant. However, in federal court, you will not have an opportunity to introduce new medical evidence or other documentation. Instead, medical evidence and documentation must have been introduced at the administrative appeal level. In federal court, a judge will have the final say on whether or not you are eligible to recover long-term disability benefits from your insurance company.
