About J. Price McNamara

Price McNamara began his law practice in 1990 representing insurance companies.

In 1995, Mr. McNamara founded McNamara Law Offices, where he represents people across the U.S. who are wrongfully denied long-term disability insurance, life insurance, and accidental death insurance benefits, with special focus on ERISA claims and lawsuits.

How to Administratively Appeal a Benefits Claim Denial

If your claim for disability benefits has been denied by your insurance company, you will first need to exhaust any and all administrative remedies. The denial letter which your insurance company should have sent you will contain information about the administrative appeals process. Specifically, the letter will indicate what you need to include with your administrative appeal package, such as additional medical documentation to prove your disability. The letter will also state the deadline by which you must file an administrative appeal in your case.

It is important to keep in mind that your record can only be updated during the administrative appeals process with your insurance company. If and when the matter ultimately winds up in federal court, you will no longer be able to supplement the record with additional medical documentation to prove your case.

How to Appeal a Claim Denial in Court

If you have exhausted all of the available administrative appeals in your case and the insurance company still has not granted your application for benefits, you may be able to file a lawsuit directly against your insurance company in the federal court system. 

Once you file your lawsuit, the insurance company will appoint a defense attorney, and both sides will engage in written and oral discovery. At the hearing before a judge, the federal judge will decide if you are entitled to disability benefits. In the federal court system, you are not entitled to a jury trial in these types of cases, and a judge must decide the outcome of any disputed issues.
