When can a Beneficiary Make a Claim for Life Insurance Benefits?

During the insured’s lifetime, and while he or she is paying premiums under the policy, the insured will designate a beneficiary. The beneficiary is the individual who is to eventually be the recipient of the life insurance benefits available under the policy. When the insured passes away, the beneficiary can then make a claim for benefits under the life insurance policy. However, in some instances, insurance companies refuse to honor the claim and wrongfully deny the beneficiary his or her benefits, for one reason or another.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Why are Life Insurance Claims Sometimes Denied?

Claims for life insurance benefits are unfortunately denied on a routine basis by some insurance companies. These claims are denied for a variety of reasons. In some cases, insurance companies feel that the insured materially misrepresented some aspects of his or her life. For example, on an insurance application, the insured might have lied about his or her age, weight, height, or pre-existing injury, illness, or other medical condition.

Insurance companies also sometimes argue that an insured’s death fell within an exclusionary provision under the policy. For example, the insured may have committed suicide or may have inflicted an injury upon himself or herself that resulted in the insured’s untimely death. In those instances, the insurance company may point to an exclusion in the policy as a basis for denying a life insurance benefits claim to a beneficiary under the policy.

If you are a beneficiary under a policy of life insurance and your claim has been denied, you may have several appeal options. First, you may be eligible to administratively appeal your claim denial with the insurance company.

If, after reviewing your appeal, the insurance company still denies your claim for life insurance benefits, you may have the option of pursuing your case in federal court, especially if the life insurance policy is an employer-sponsored ERISA plan.

During the federal court appeal, the insurance company becomes the defendant, and each side will engage in written discovery. At the court hearing, a federal judge will be tasked with deciding whether or not you are to be awarded benefits under the policy. A life insurance claims lawyer in Fort Worth will do everything possible to help you obtain the life insurance benefits to which you are entitled under the policy.
