Life Insurance Benefits Denials in Texas

Assisting Texans with Responding to a Life Insurance Benefits Denial and Pursuing the Benefits that they Deserve

Being denied life insurance benefits in Texas can be difficult to deal with. In fact, insurance companies have a strong incentive to deny benefits of any kind under an insurance policy. This is because the insurance company’s primary goal is to keep as much of its money in-house as possible. The less money that the insurance company has to pay out in satisfaction of a claim means more money that it can distribute to its shareholders.

If you are the beneficiary under a loved one’s life insurance policy and you have been denied life insurance benefits by your insurance company, it is essential that you have an experienced attorney representing you. The legal team at the Law Offices of J. Price McNamara is ready to help you pursue the benefits that you need. Please contact us online today for more information and to schedule a free case evaluation and legal consultation.

Parties to a Life Insurance Contract

There are several individuals who are parties to a life insurance policy. First of all, a life insurance policy is a type of contract between the insured and the insurance company. The insured individual under the contract agrees to pay premiums (usually on a monthly basis), in order for the contract to remain in effect.

The insured also designates one or more beneficiaries under the policy who will be eligible to obtain a payout once the insured passes away. However, in certain instances, the insurance company will try and deny a beneficiary’s right to receive a payout under the policy for a variety of reasons.

Denying a Payout to a Life Insurance Beneficiary

There are many reasons why a life insurance company may decide to deny a payout to a beneficiary under a life insurance policy. In some cases, the circumstances surrounding the insured’s death may fall within a policy exclusion.

In other cases, the insurance company may claim that the insured made material misrepresentations of fact on the life insurance application. For example, the insured may have been misleading about his or her age or health condition – and may have even failed to disclose a pre-existing medical condition.

Finally, the insurance company may argue that the insurance policy lapsed because the insured failed to pay his or her insurance premiums.

Our number-one goal is getting you and your family back to financial security as soon as possible.
