Life Insurance Benefits Denial Attorney in Dallas

Assisting Residents of Dallas, Texas with Responding to a Life Insurance Benefits Denial

Life insurance policies are contracts between insureds and their insurance company. The insured is the individual who pays premiums throughout the life of the policy in order for the policy to remain in effect. When the insured passes away, the beneficiary or beneficiaries whom the insured designated should be entitled to a payout. Unfortunately, however, circumstances do not always work out that way.

There are many reasons why insurance companies may try and deny life insurance benefits to designated beneficiaries under life insurance policies. In fact, the insurance company has a strong incentive to do this, since it does not make any money by paying out a claim. The way that insurance companies make most of their money is by collecting premiums from their insureds and doing everything possible to keep this premium money in-house.

If you have been denied the life insurance benefits that you deserve, an experienced life insurance benefits denial attorney in Dallas at the Law Offices of J. Price McNamara may be able to assist. Our experienced legal team can review your circumstances, explain all of your legal options, and may be able to assist you with appealing your claim, either administratively or in the federal court system.

Why was my Life Insurance Claim Denied?

There are numerous reasons why a claim for life insurance benefits might be denied. On the one hand, the insured may have stopped paying premiums at some point during the life of the policy, and the policy may have lapsed. Therefore, the insurance company may conclude that at the time the insured passed away, the policy was not in effect.

At other times, the insurance company might contend that the insured made one or more material misrepresentations of fact on the initial life insurance application. For example, the insured may have lied about his or her age, general health, or medical condition. Similarly, the insured might not have disclosed a material pre-existing medical condition that could have impacted his or her benefits coverage.

Finally, the policy beneficiary might not have followed all of the insurance company’s protocols for bringing a claim in the first place, and thus, the insurance company may have chosen to deny the beneficiary’s claim.

Steps to Take Once Your Claim has been Denied

If your claim for life insurance benefits has been denied, the first thing that you should do is to review the denial letter that the insurance company must send you in order to deny a claim. The denial letter will set forth the procedures that you must follow in order to administratively appeal the claim denial. If your efforts at an administrative appeal are unsuccessful, you may have the option of appealing your case to federal court – especially if the life insurance policy falls under ERISA.

Our number-one goal is getting you and your family back to financial security as soon as possible.
