When is it Necessary to File an Appeal?

When the policyholder passes away, a designated beneficiary or beneficiaries will have the right to make a claim under the policy. However, the insurance company, for some reason, may decide to deny the policy payout. In some cases, the insurance company may contend that the death of the insured fell within a policy exclusion. 

At other times, the insurance company may allege that the beneficiary did not make his or her claim for benefits within the required time period. Finally, the insurance company may deny a benefits payout when there is a dispute over the identity of the true beneficiary under the policy, most especially when there are two or more claimants.

In the event a claim for life insurance benefits is filed and the insurance company denies the claim, it will become necessary for the beneficiary to appeal that claim denial. The first step in the process is to file an administrative appeal directly with the insurance company. During this stage in the game, the beneficiary has the option of submitting additional documentation, in an attempt to get the insurance company to change its mind.

Once the insurance company has reviewed the administrative appeal, it will make a decision. If benefits are denied again, then the beneficiary may be able to appeal the case to federal court. This is especially true if the plan was sponsored by the insured’s employer, and it fell within the Employee Retirement Income Security Act of 1974 (ERISA).

Federal court litigation can sometimes be a long and drawn-out process. Moreover, in federal court, a jury does not decide the outcome of the case. Instead, a federal judge will review the administrative record and make a final decision in the case about the individual’s entitlement to benefits.
