Life Insurance Appeals Attorney in Dallas

Helping Citizens of Dallas, Texas with Appealing a Denial of Life Insurance Benefits

Many people purchase life insurance plans through their employers, in hopes that their loved ones will be protected when the time comes that they pass away. When a life insurance plan is covered by an employer, the plan typically falls under the Employee Retirement Income Security Act of 1974, otherwise known as ERISA.

Unfortunately, under this federal statute, insurance companies have a strong incentive to deny life insurance benefit plans, and they will do so for a variety of reasons. If you are the designated beneficiary under a plan of life insurance, and the insurance company has denied your application, it is essential that you have experienced legal representation standing by your side at all times. The life insurance appeals attorneys in Dallas at the Law Offices of J. Price McNamara are ready to help you pursue the benefits you deserve.

Please reach out to us today to learn more about how we can assist you with your legal matter and advocate for your interests.

Why an Insurance Company Might Deny Your Benefits Claim

There are many reasons why an insurance company might deny your claim for life insurance benefits under an insurance plan. Some common reasons for life insurance benefits denials include the following:

  • The insurance company may deny a benefits payout if the circumstances behind the insured’s death fall within a policy exclusion. For example, the insured may have committed suicide or may have done something to contribute to his or her own death, in which case, the insured’s death falls outside the policy.
  • The insurance company may also deny a benefits payout if there is a dispute as to the identity of the designated beneficiary under the plan. The insured is responsible for designating a beneficiary when he or she first takes out the plan. However, disputes sometimes arise.
  • Finally, the insurance company may deny a life insurance benefits payout if the beneficiary did not file the claim in a timely manner or otherwise failed to abide by the protocols and procedures established by the insurance company for asserting a benefits claim.

Appealing a Life Insurance Benefits Claim Denial

In the event you are a designated beneficiary under a life insurance plan, and the insurance company denies your claim for benefits, you may be able to file an appeal of that claim denial. The first thing that you will need to do is to review the denial letter which the insurance company sends you. The denial letter will state the reason or reasons why the insurance company has decided to deny your claim. Moreover, the letter will establish the deadlines and dates by which you must file your administrative appeal.

It is extremely important that you comply with these requirements. If you do not, there is a very good chance that your benefits claim will be denied again.

If the insurance company denies your claim for benefits a second time, and the plan is covered under the Employee Retirement Income Security Act of 1974 (ERISA), which is a federal statute, then you may be able to file a claim directly against the insurance company in the federal district court and pursue litigation there. At the conclusion of the case, a federal judge will determine your eligibility for benefits under the subject insurance plan.

Our number-one goal is getting you and your family back to financial security as soon as possible.
