Why is a Claim Denied?

If your claim for long-term disability benefits has been denied, you are probably wondering why. In many instances, long-term disability claims (especially initial claims) are denied because of insufficient medical documentation. Remember that the medical documentation provided must establish both of the following elements:

  • That you are unable to work at your current job, or in the alternative, that you are unable to work at any job
  • That you cannot work because you are currently suffering from a long-term illness or a long-term injury, which is expected to continue well into the foreseeable future

If the medical documentation provided does not fully support both of those elements, it is very likely that your claim will be denied. Your claim might also be denied for failing to follow certain administrative or procedural requirements. In order to determine exactly what went wrong with your claim, you should read the denial letter thoroughly and show that letter to your attorney. That way, an attorney can help to ensure that the same efficiencies aren’t present when you go to appeal your claim denial. 

How to Deal with a Denial of Benefits

If you have been denied benefits, you may have one or two levels of administrative appeals which you can (and should file). If you are pursuing benefits under an ERISA plan which is sponsored by your employer, you are required to first exhaust your administrative appeal remedies prior to filing an ERISA lawsuit in the federal court system against your insurance company.

Even if you are pursuing benefits under an individual insurance plan, it is still advisable to exhaust your administrative remedies prior to pursuing costly (and lengthy) litigation in the federal court system.
