About J. Price McNamara

Price McNamara began his law practice in 1990 representing insurance companies.

In 1995, Mr. McNamara founded McNamara Law Offices, where he represents people across the U.S. who are wrongfully denied long-term disability insurance, life insurance, and accidental death insurance benefits, with special focus on ERISA claims and lawsuits.

Contestable Period

Life insurance companies have a myriad of reasons that they use to try and deny benefit claims made by policy beneficiaries. These contests often arise during the policy’s two-year “contestable period.” In the event the insured individual passes away within two years of the date on which he or she buys the policy, the insurance company can begin an investigation. This investigation typically includes looking at the circumstances behind the insured’s death, along with the actual contents of the insurance application. 

During this investigation, the insurance company will carefully look at the insurance application which the insured filled out previously. Specifically, the insurance company will be looking for any inconsistencies and other bases for denying the insurance claim. 

Why Insurance Companies Deny Life Insurance Claims

There are many different reasons why a life insurance company might deny a claim made by a beneficiary. Those reasons could include any of the following:

  • Preexisting and non-disclosed medical conditions
  • Failing to file a claim in a timely manner
  • Beneficiary designation disputes
  • Application forms that were not completed correctly
  • Certain behaviors or activities that caused the insured’s death and which were not covered under the policy language
