How to Know if ERISA Comes into Play

The federal ERISA statute typically comes into play when an employer sponsors your plan of insurance. These plans of insurance can cover various types of benefits, including health insurance benefits, accidental death benefits, long-term disability benefits, short-term disability benefits, and life insurance benefits, to name only a few.

When a certain life event happens, the insured policyholder, or in some cases the beneficiary, may be eligible to make a claim under the subject insurance policy. For example, in the case of long-term disability benefits, the policyholder may be able to make a claim against the policy if he or she suffers an illness or an injury that keeps him or her from working at any time. Similarly, in the case of life insurance benefits under an ERISA policy, the beneficiary who is named under the policy may be able to make a claim for a monetary payout once the insured policyholder passes away.

ERISA Claim Denials

There are many circumstances where an insurance company may decide to deny an ERISA claim. In general, it is extremely beneficial for insurance companies to deny ERISA claims, because that means that the insurance company gets to keep all of its premium money in house. This money can then be distributed to the insurance company’s shareholders at regular intervals.

In some instances, an ERISA claim may be denied because the insured did not provide sufficient documentation. For example, in the case of long-term disability benefits, the insured may not have attached medical documentation that supports that he or she cannot work due to the long-term illness or injury from which he or she suffers.

Alternatively, a claim may be denied if it falls within a certain policy exclusion. For example, an insurance company may deny an ERISA insurance claim for life insurance or accidental death benefits, if there is evidence which shows that the insured policyholder contributed to his or her death.

Filing an Appeal

If your ERISA claim is denied, you may have the option of filing an appeal. The first step is to review the denial letter issued by your insurance company and figure out what went wrong. When you file your administrative appeal, you can attach additional documents in support of your claim. Once you have exhausted the administrative appeals process provided by your insurance company, if you still do not have the benefits you need, you may be able to file suit against your insurance company in the federal court system.
