Assuming you have met the requirements for pursuing disability benefits, you would then need to file a claim. In some cases, an insurance company may accept your claim and award your benefits. More often than not, however, insurance companies deny these benefits claims by way of a denial letter. It is then incumbent upon the insured to file an administrative, in-house appeal with the insurance company in pursuit of their benefits.
In the event the administrative appeal protocol is unsuccessful, the insured will need to further appeal the benefits denial in federal court. In the federal court system, a judge will make the final decision about whether or not you are entitled to receive disability insurance benefits.
