Houston Denied Insurance Claims Lawyer

Assisting Individuals in Houston with Appealing a Denied Insurance Claim

It is not uncommon for insurance claims made under employer-sponsored policies to be denied. Although the Employee Retirement Income Security Act of (1974) – or ERISA – was put in place to ensure that employees receive the various benefits to which they are entitled, that does not always happen. Instead, insurance companies routinely look for an excuse to deny insureds their various benefits, resulting in the need for an appeal.

The Houston denied insurance claims lawyers at the Law Offices of J. Price McNamara could help you deal with an insurance company claim denial and help you fight for your right to the benefits that you deserve. If you have been denied benefits under an insurance claim, please contact us online today for more information and to schedule a free case evaluation and legal consultation.

Reasons for Insurance Claim Denials

There are numerous reasons why your insurance company might deny your claim for benefits. Typical reasons for claim denials include the following:

  • You did not file your claim in a timely manner
  • You were not eligible to make a claim under your insurance policy (e.g., you were not a designated beneficiary under the policy)
  • You did not include all of the pertinent documentation along with your claim

The first step that you should take following an insurance claim denial is to review the denial letter from your insurance company very carefully. That letter should explain exactly why your claim has been denied and should set forth the steps that you must take to file an administrative (internal) appeal. In many cases, claims are denied because they do not include sufficient medical documentation or other documentation necessary to support the claim.

Failing to file the proper administrative appeal protocols – or filing an appeal after the deadline – could result in your administrative appeal being denied by your insurance company.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Litigating a Claim Denial

If the administrative appeal process is not successful, you then have the option of filing an appeal in the federal court system. After presenting evidence and arguments at a hearing, a federal judge will then have the final call as to whether or not you are entitled to benefits.

Federal litigation is oftentimes tedious, and litigants do not have the option of a jury trial. Moreover, in federal court, an insured does not have the option of filing a bad faith claim against his or her insurance company, based upon a claim denial.
