Prerequisites to Filing a Federal Court Lawsuit

In order to qualify for long-term disability benefits, it is necessary for you to suffer from a long-term or permanent illness or injury that prevents you from working in any capacity. If you need to supplement the administrative record with additional medical documentation, it is important that you do this during the administrative appeals process. This is because once the appeal moves to federal court, you will no longer have an opportunity to supplement the record.

The insurance company is required, by law, to offer you at least one chance to administratively appeal your claim denial. Once you have exhausted all of the administrative appeal options offered by the Hartford, if you still do not have the benefits you need, you may have the option of litigating your case in federal court.
