Primary Reasons for a Claim Denial

There are several reasons why an insurance company might deny your claim for long-term disability benefits. In cases of a first-time denial, the reason might be that you did not follow all of the procedural hurdles and requirements for submitting your claim in the first place. Another common reason why disability claims are denied for the first time is that they do not include sufficient medical documentation. The medical documentation must demonstrate not only that you have a long-term illness or injury, but also that your injury prevents you from working in the long term. 

One way to make sure that you include the necessary documentation is to find a doctor who genuinely believes that you are disabled and who can make the necessary notations to that effect in your medical records. 

In some instances, second appeals are denied because of inadequate medical documentation, but at other times, they are denied because the individual misses a deadline and does not file the appeal in a timely manner.

The best way to ensure that you do not receive another denial is to carefully read the denial letter which the insurance company sends. The denial letter must specifically state why the insurance company denied your claim package and should delineate all of the time frames that you need to follow in order to appeal your case.

Obtaining Benefits through the Appeal Process

One way that you may ultimately be able to obtain the benefits that you deserve is by going through the administrative appeal process. Once you have exhausted all of your administrative appeals, you could still seek benefits by filing a federal lawsuit in the court system and litigating your case against the insurance company.

If you are claiming long-term disability benefits from an employer-sponsored ERISA plan, you are required to exhaust all of your administrative appeals prior to filing a federal lawsuit. It is still a good idea to do this even if you have a private insurance policy.
