How is ERISA Involved?

ERISA, which is a federal statute, becomes involved if you are seeking benefits under an employer-sponsored long-term disability plan. Under the ERISA statute, employers and plan administrators are not permitted to illegally interfere with benefits which are provided to you under the plan. Moreover, they are not allowed to terminate, fine, or take any other legal action against a plan participant who is seeking to obtain his or her rightful benefits under the plan.

Filing an Appeal

The appeals process for a long-term disability benefits denial under an ERISA plan is twofold. The first step is to exhaust any administrative appeals. Depending upon the insurance company and the insurance policy at issue, you might be eligible to file up to two of those appeals.

Once your administrative appeals are exhausted, you may be eligible to file an ERISA lawsuit against your insurance company in federal court. 

Documentation to Include as Part of Your Appeal

When you are appealing a denial of long-term disability benefits under an ERISA plan, it is essential that you include all of the necessary documentation which pertains to your long-term injury or illness. This documentation includes all medical records, MRIs, x-rays, and other medical records and notes which establish that you have a long-term illness or disability that is expected to last. The documentation must also show that you are unable to work — either at your current job or at any other job.

All of this can be difficult to prove, and it is essential that you have a healthcare provider on your side who is on board with your disability claim.
