Eligibility to Bring a Disability Claim

Not everyone is eligible to bring a claim for disability benefits. In order to file a claim, there are certain prerequisites that you must satisfy. First of all, you must currently be suffering from an injury or illness that is long term or permanent in nature. Secondly, that injury or illness must prevent you from working. It is not enough that you are unable to work at your current job. In order to collect long-term disability benefits, you must be precluded from working in any capacity.

If you feel that your injury or illness prevents you from working, the first step prior to filing a claim is making sure that you have your healthcare provider on board. Your doctor must be able to state, to a reasonable degree of medical certainty, that your injury or illness does not allow you to work at any job. When you bring a claim for disability benefits, you will need to attach this medical documentation in support of your claim. Once you submit your claim, it will be reviewed by the insurance company.

How to Appeal a Denial of Your Fort Worth Disability Claim

Once an insurance company reviews your claim materials, it will decide whether to accept the claim and award you long-term disability benefits, or alternatively, to deny the claim. It is not unusual for disability claims to be denied for lack of sufficient medical documentation. If this happens, you should first review the denial letter sent by your insurance company. You should then attempt to correct any deficiencies within the specified time period. If you fail to address these deficiencies, your claim for disability benefits will be denied again.

The first step in the appeals process is to file an administrative appeal with your insurance company. Once you submit the new documentation, your insurance company will review the claim again and make a decision. If your claim is denied for a second time, you may have one more administrative appeal option. If that does not work, you have the option of suing your insurance company in the federal court system.
