Fort Worth Disability Appeals Attorney

Helping Individuals in Fort Worth, Texas Appeal a Denial of their Disability Claims

If you are making a claim for long-term disability benefits under an ERISA plan that is employer-sponsored, you may find that you are facing an uphill battle. One of the reasons for this uphill battle is that insurance companies have a strong incentive to deny your claim. They know that if the appeal ultimately proceeds to federal court, you are not entitled to a jury trial by your peers. Instead, a federal judge will make the final decision in your case – a procedural hurdle that favors insurance companies. Moreover, the disability appeals process itself is multi-faceted and can be extremely confusing.

Fortunately, however, there is hope. If you have been denied benefits for long-term disability under your employer-sponsored insurance plan, the knowledgeable Fort Worth disability appeals attorneys at the Law Offices of J. Price McNamara could assist. Our legal team understands how insurance companies work and can advance compelling arguments to help you pursue the benefits you need.

Appealing a Benefits Denial Administratively

The first step in appealing an insurance company’s denial of long-term disability benefits is to file an internal administrative appeal with your insurance company. When your insurance company decides to deny you your long-term disability benefits, it must first send you a very detailed letter telling you why. The letter must also explain the following:

  • The steps that you must take to file an administrative appeal
  • Any supplemental documentation which you must attach to your administrative appeal
  • The deadline by which any administrative appeal and accompanying documentation must be received by your insurance company

If you fail to meet the deadlines that are outlined in your denial letter – or if you do not provide the requested documentation – your administrative appeal has a very good chance of being denied again. A Fort Worth disability appeals lawyer will work to ensure that your administrative appeal is timely filed and that it includes all of the necessary supplemental documentation.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Appealing a Benefits Denial through the Federal Court System

If an insurance company denies your administrative appeal, you could then appeal your case in the federal court system and litigate it to trial. As part of the litigation process, there will likely be discoveries that each party needs to complete. Once the case gets to a hearing, the federal judge who is assigned to the case will listen to any oral arguments which are made by the parties’ attorneys. The federal judge will then render a decision in the case regarding an insured’s entitlement to benefits.
