Reasons for Life Insurance Benefits Denials

Life insurance policies are set up with an insured and a designated beneficiary. During the lifetime of the life insurance policy, the insured pays premiums, typically on a monthly basis. The insured must also designate a beneficiary will receive a payout once the insured passes away.

In some instances, however, when the beneficiary goes to make a claim under the policy of life insurance, the insurance company decides to issue a claim denial. This denial may happen for many reasons. In some instances, the claim may be denied because the policy lapsed during the insured’s lifetime. In other cases, the circumstances of the insured’s death may fall within a policy exclusion. For example, the insured may have done something to bring about his or her own death, and therefore, a policy exclusion comes into play. Insurance companies often look for any reason to deny life insurance claims – or to at least limit a payout under the policy. 

Appealing a Claim Denial

In some cases, especially if you receive life insurance through your employer, your policy may fall under the Employee Retirement Income Security Act of 1974 (ERISA). If your policy falls under this federal statute, then it is necessary for you to exhaust all administrative appeals with your insurance company before appealing your case to the federal court system. 

If the insurance company denies your administrative appeal, then you may be able to file a lawsuit directly against your insurance company in the federal court system. At that point, a federal judge will determine the outcome of your case.
