ERISA Litigation Lawyer Near Me

Helping Individuals in Texas Litigate their ERISA Matters

ERISA – formally known as the Employee Retirement Income Security Act of 1974 – is a federal statute that was enacted with hopes of ensuring that employees receive the benefits to which they are entitled under employer-sponsored plans. As the law evolved, however, that was not always the case, as the law instead came to indirectly benefit insurance companies – especially during the appellate process.

Since ERISA is a federal statute, all appeals are handled in the federal court where a judge (and not a jury) makes the final decision in a dispute. Moreover, in the federal court system, individuals who have been wrongfully denied benefits under an employer-sponsored insurance plan are not eligible to make a claim for bad faith against their insurance company.

Litigation in the federal court system can be difficult and time-consuming. If you have exhausted all of your appeal remedies at the administrative level, the knowledgeable Texas ERISA litigation lawyers at the Law Offices of J. Price McNamara could assist you with litigating your appeal in federal court. Please contact us online today for more information and to schedule a free case evaluation and legal consultation.

Beginning the Litigation Process

Once you have exhausted your administrative appeals (one or two, depending upon your insurance company), you could decide to file a lawsuit in the federal court system. The litigation process begins when you file a complaint against your insurance company in federal court. After your insurance company appoints a lawyer and he or she files an answer to the complaint which you filed, the discovery process will begin.

During the discovery stage of litigation, the parties typically exchange written questions, called interrogatories. Once discovery concludes, there will be a federal court hearing.

Our number-one goal is getting you and your family back to financial security as soon as possible.

What Happens at a Federal Court Appeals Hearing?

Hearings in federal court take place before a federal court judge, rather than a jury. The judge will decide your case based upon the administrative record. During federal court hearings, the insured is not allowed to introduce new evidence or documentation – including new medical documentation. The judge must rely upon the insurance company record when deciding the outcome of your case. Consequently, it is important that you introduce any supplemental medical records and other documentation at the administrative level.
