About J. Price McNamara

Price McNamara began his law practice in 1990 representing insurance companies.

When Does ERISA Apply?

ERISA typically applies to benefits that are covered under insurance plans that are sponsored by an employer. ERISA plans can cover various different types of benefits, including all of the following:

In some instances, individuals may be able to make a claim under an ERISA policy upon the happening of a certain event. At other times, such as with life insurance benefits under an ERISA plan, one or individuals may be designated as the beneficiary under the policy and may be entitled to recover monetary benefits once the insured passes away.

The claims process begins when the insured individual or the beneficiary attempts to collect the benefits to which he or she is entitled to under the insurance policy. When an individual makes a claim, he or she must usually submit certain documentation. For example, if the individual is a beneficiary under a life insurance policy, he or she must ordinarily submit a copy of the insured’s death certificate prior to collecting on a claim for benefits. 

ERISA Litigation

ERISA litigation begins when an insured, or beneficiary under an insurance policy files a lawsuit against the insurance company in federal court. However, prior to taking this step, you must exhaust all of your administrative appeal remedies afforded to you by your insurance company.

If the appeal does ultimately proceed to federal court, the appeal outcome will not be decided by a jury of your peers. Instead, the matter will be resolved by a federal judge who will issue a decision in your case.
