ERISA Disability Benefits Appeal in Texas

Assisting Texans with Appealing a Denial of their ERISA Disability Benefits

Nothing can be more frustrating than being denied the disability benefits you deserve under an employer-sponsored ERISA plan. After all, you pay your premiums, and you expect that your insurance company will hold up its end of the bargain. Unfortunately, however, that does not always happen, and insurance companies seem to look for any reason to deny a claim for benefits.

An insurance company may deny you benefits for any number of reasons, but the underlying reason usually has to do with the insurance company trying to save itself money. In the end, the insurance company is a business and is primarily looking out for its own financial interests, rather than your financial interests.

If you have been denied the benefits you deserve under an employer-sponsored ERISA plan, the knowledgeable Texas ERISA disability benefit appeals lawyers at the Law Offices of J. Price McNamara could assist you with appealing your claim denial. Our legal team can explain the steps involved in the appeals process and can pursue the benefits you need. Please contact us online today for more information and to schedule a free case evaluation and legal consultation.

Too much is at stake to guess about the best approach and strategy for fighting your denied insurance claim — years and years of financial security.

After spending years representing insurance companies, we don’t guess. We know their playbook and how they work behind the scenes. Using that knowledge, we’ve developed our own Clear Advantage Process for fighting claims.

It’s personally satisfying to use what I’ve learned as an insurance company insider, now for the good — helping families reverse unfair denials of insurance benefits they paid for, need and deserve.

What is an Administrative Appeal?

The administrative appeals process is the insurance company’s own internal appeals process and takes place outside of the federal court system. Insurance companies, by law, are required to offer you at least one chance at an administrative appeal, and some insurance companies allow for two administrative appeals.

When the insurance company first denies your claim, it must send you a denial letter that specifically sets forth the reason or reasons why your claim for benefits is being denied. The letter will also outline the steps you must take to file an administrative appeal, as well as the time deadlines you must follow.

In many instances, claims are denied at the administrative level because of incomplete medical documentation. The documentation in the file must be sufficient to demonstrate that you are disabled within the definition of your insurance policy. An experienced Texas ERISA disability benefits appeals attorney could assist you with filing the administrative appeal in your case.

Filing an Appeal in the Federal Court System

Once you have exhausted the administrative appeals process, you may be able to file an appeal in federal court. Once you file your appeal, your attorney will prepare a legal brief for review by the court and can represent you at the hearing. The federal judge presiding over the case will then make the final decision about benefits in your case.

Our number-one goal is getting you and your family back to financial security as soon as possible.
