Explaining the ERISA Statute

In 1974, Congress enacted the federal ERISA statute to help ensure that employees received all of the benefits to which they were legally entitled – including benefits for long-term disabilities. Over the years, however, ERISA has tended to indirectly benefit insurance companies. For example, under the federal statute, ERISA disability denials are handled in the federal court system – a venue where insureds are not entitled to a jury trial. This lack of a jury trial favors insurance companies, and as a result, insurance companies will do everything that they possibly can to avoid paying you benefits for a long-term disability.
