Generally speaking, when various circumstances arise, you or your beneficiary become eligible to make a claim under the policy. Surprisingly, however, insurance companies routinely deny claims made under ERISA policies. These insurance companies are acutely aware that the ERISA statute strongly benefits them in the long run, and they are willing to limit or deny benefits payouts in order to increase their bottom line. 

Appealing an ERISA Benefits Denial

Insurance companies routinely deny benefits under insurance plans for a number of different reasons. In some cases, the insurance company may allege that the insured (or in some cases the beneficiary) did not make a timely claim under the policy or did not follow the proper protocols in order to assert a valid claim. At other times, especially in the case of long-term disability insurance policies, the insurance company may argue that the insured did not include sufficient medical documentation to prove his or her entitlement to benefits. 

If you have been denied benefits under an ERISA insurance policy, you have the option of filing one or more administrative appeals with your insurance company. Once your administrative appeal or appeals have run out, you may file a lawsuit against your insurance company in federal court, after which a judge will decide the outcome of the case.
