ERISA is an abbreviation that stands for the Employee Retirement Income Security Act of 1974. This federal statute, which was enacted by the United States Congress in 1974, was initially put in place to help ensure that employees receive the insurance benefits to which they are entitled.

Although ERISA was originally enacted for the benefit of employees, the statute now tends to favor insurance companies and employers. This is because during federal ERISA litigation, a judge, instead of a jury, will be the decision-maker in the case.

About J. Price McNamara

Price McNamara began his law practice in 1990 representing insurance companies.

In 1995, Mr. McNamara founded McNamara Law Offices, where he represents people across the U.S. who are wrongfully denied long-term disability insurance, life insurance, and accidental death insurance benefits, with special focus on ERISA claims and lawsuits.

His is a member of the Louisiana and Texas Bars, with office locations by appointment only in Baton Rouge, Metairie, and Houston. He lives in Baton Rouge, Louisiana with his wife and their three children.

Making a Claim for Benefits and Appealing an ERISA Claim Denial

Benefits available to you under an ERISA policy depend upon the type of insurance policy at issue. ERISA policies can cover benefits for life insurance, accidental death, and long and short-term disability, for example.

When a certain life event occurs, you or the designated beneficiary under the policy may be able to bring a claim for benefits. For example, if you have a long-term disability benefits ERISA policy, you may be able to bring a claim if you suffer an illness or injury that keeps you from working in any capacity at any job.

Once you bring your claim for benefits, the insurance company will review the claim, along with any supporting documentation, and make a decision about whether to accept or deny the claim. If your claim is denied, you may be eligible to appeal that claim denial and pursue the benefits you deserve. 

If you decide to appeal an ERISA benefits denial, you must first exhaust all of the administrative remedies which your insurance company provides. During this stage, you may supplement the record with new documentation in support of your ERISA benefits claim. Once you have exhausted your insurance company’s administrative appeals process, you can appeal your case to federal court.
