There are many different types of employer-sponsored benefits that fall within the ambit of the federal ERISA statute. Common types of ERISA benefits include the following:

In order to make a claim for one of these types of benefits, some triggering event must ordinarily happen. For example, in the case of long-term disability benefits under an ERISA policy, the employee must suffer an injury or illness that prevents him or her from working in any capacity. Likewise, in order for a life insurance beneficiary to make a claim for benefits, the individual who is insured under the policy must pass away, and there must not be any policy exclusions that apply.

In some cases, after making a claim for insurance benefits under an ERISA policy, the insurance company will deny the claim. This can happen for many different reasons, and the insurance company is required to inform you – in writing – as to the reason for the claim denial.
