How ERISA Puts People Seeking Benefits at a Disadvantage

Assuming a person makes a claim for benefits against a homeowner’s insurance policy or against an automobile insurance policy, state law applies. If a person is subsequently unable to resolve the claim, he or she can sue in state court where the case is heard by a jury. As ERISA preempts state law, a person bringing a lawsuit related to an ERISA-covered plan will instead find themselves in federal court, having their case reviewed by a judge instead of being heard by a jury. Additionally, the person seeking benefits has no right to testify, and even if the insurance company’s denial is meritless, the person suing is precluded from asserting a bad faith denial claim. Given all of these complications, representation by a knowledgeable Fort Worth ERISA attorney is necessary.

How to Know if ERISA Applies

ERISA applies to employer-provided benefits and insurance.  If a person is employed by a public or government organization or a religious entity, his or her insurance is not likely covered by ERISA. Additionally, if a person pays his or her own premiums or purchased his or her own insurance, ERISA does not apply.
