El Paso Insurance Claims Attorney

Helping People in El Paso Make a Claim for Insurance Benefits or Appeal a Denial of their Benefits

A variety of insurance benefits, including benefits for long-term disabilities and illnesses, life insurance, and health benefits, are oftentimes available under employer-sponsored plans. If your insurance benefits are covered by your employer, it is extremely likely that the Employee Retirement Income Security Act of 1974, also known as ERISA, covers your insurance plan. It also likely means that any benefits dispute under the plan will be covered under federal law.

The knowledgeable El Paso insurance claims attorneys at the Law Offices of J. Price McNamara could help you pursue insurance benefits from your insurance company when the need arises. If your insurance company denies your claim for benefits, our legal team could assist you throughout the administrative appeals process – and during any appeal that proceeds in the federal court system.

What does Filing a Claim Entail?

Making a claim for insurance benefits typically entails filing the necessary paperwork with the insurance company to support your claim. For example, if you are making a claim for long-term disability benefits, you will need to show that you are suffering from a serious and long-term injury or illness that prevents you from working in any capacity. In order to demonstrate that your injury or illness is long-term, you will need to attach pertinent medical documentation which supports this finding, and your doctor will need to be on board.

In some instances, after you file your claim, the insurance company might send you a denial letter. When that happens, you will need to follow all of the insurance company’s internal procedures to administratively appeal your benefits claim denial.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Why do Insurance Companies Deny Claims for Benefits under an Insurance Policy?

There are many reasons why insurance companies routinely deny claims for benefits. In some instances, these claims are denied because they lack sufficient supporting documentation. The main reason, however, is because insurance companies know that federal law is on their side.

If the insurance company continues to deny your claim following an administrative appeal, you will need to appeal your claim denial in federal court. ERISA laws are complicated and do not allow for a trial-by-jury. Instead, a federal judge will make the final decision about whether or not you are entitled to insurance benefits. Consequently, there is a strong incentive for insurance companies under employer-sponsored benefit plans to deny you the benefits you need in the first place.

An experienced El Paso insurance claims attorney will know the tricks and tactics that insurance companies often use to deny claims and can help you pursue the benefits you deserve – initially and on appeal in federal court.
