Appealing the Claim Denial with Your Insurance Company

The part of the appeals process where you deal with just the insurance company is called the administrative appeals process. During this process, you will need to supply your insurance company with additional documentation to support your claim. If you do not have a healthcare provider who is willing to state that you are suffering from a long-term injury or illness that prevents you from working, you need to find one. Also, at the administrative appeal level, you can introduce as much documentation as necessary to support your appeal. Once the administrative appeals process has concluded, you cannot further supplement the record.

Federal Court Litigation

Litigating your appeal through the federal court system can be a long and tedious process. Moreover, in federal court, you are not entitled to a trial by jury, and you can no longer supplement the administrative record with new medical documentation.

If you decide to appeal your case in the federal court system, you must have first exhausted all of your administrative remedies. You may then file a lawsuit directly against your insurance company, in which the insurance company becomes the defendant. In federal court, a judge will make the final decision about your entitlement to benefits.
