What Happens if Your Insurance Claim is Denied?

You may be able to make a claim for insurance benefits if you are the named insured, or in some cases, the beneficiary, under the subject insurance policy. If you make a claim against the policy with your insurance company and the insurance company denies your claim, then a series of events will begin to unfold.

First, the insurance company must send you a denial letter explaining why it decided to deny your claim for insurance benefits. In some cases, the claim may have been denied for non-payment of insurance premiums during the lifetime of the policy. At other times, the insurance company may believe that the circumstances at issue fall squarely within an applicable policy exclusion. In the case of long-term disability benefits, the insurance company may believe that you do not suffer from a permanent injury or illness that prevents you from working at a job. 

Once you receive the denial letter from your insurance company, you will have the option of administratively appealing the claim denial within a specified period of time. During this administrative phase, you can supplement the record with additional medical documentation or any other documentation that you may wish for your insurance company to review. The insurance company will then review these materials and make a decision.

If you have exhausted all of the administrative remedies made available to you through your insurance company, you may be able to pursue litigation in the federal court system. You begin this process by filing a complaint against your insurance company in federal court. Following the litigation process, a federal judge will decide the outcome of your case.
