Two Levels of Appeal

When it comes to appealing a disability insurance benefits denial, there are two steps to the appeals process. The first step, or level, is the administrative appeals level. The second level is the federal court litigation level.

At the administrative appeal level, you will have the ability to supplement the record with medical documentation in support of your disability claim. Therefore, you want to make sure that you have an experienced healthcare provider on board who truly believes in your disability case. Administrative appeals are filed directly with the insurance company, and once the insurance company receives the supplemental documentation, it will review everything and make a decision in your case. If the insurance company then believes that you are truly disabled, it will grant the appeal. However, if the insurance company denies the administrative appeal, you will need to take further action.

Some insurance companies allow for a second level of administrative appeal. However, once the administrative appeals process is exhausted, you may then need to resort to the second level of appeal, which is appealing your case to the federal court system.

Federal Court Litigation

Federal court litigation begins when the insured decides to file a lawsuit, or a formal legal complaint, directly against his or her insurance company in the federal district court system. At the federal court level, you will no longer have the ability to supplement the administrative record with additional documentation, including medical documentation.

The federal judge who is overseeing your case will hold a hearing and will consider the documentation in the administrative record. Once the judge has reviewed everything, he or she will issue a decision regarding your entitlement to disability benefits. The judge’s decision is final, and there is no jury that takes part in the process.
