First Step to Appealing a Disability Claim Denial

It is not unusual for an insurance company to deny a claim for disability benefits. This is especially true if the applicant is making a long-term disability claim for the first time. Insurance companies typically deny these claims based on a lack of sufficient medical documentation. In other words, the insurance company denies the claim because there is no (or insufficient) documentation to support that the individual is unable to work because of an injury or long-term illness.

In the event your insurance company denies your claim for disability benefits, you have the option to file an administrative appeal. During this part of the appeals process, you can supplement the medical record. Supplemental medical documentation may include a letter from your doctor, who states that your injury or illness keeps you from working at any job.

Although you can supplement the record at the administrative appeal level, you will not have the ability to do this at the federal court level. This process begins when you file a lawsuit against your insurance company in the federal district court system. Once the appeal is filed, the insurance company will retain legal counsel, and the discovery process will begin.

At a federal court hearing, a judge will decide the outcome of your case and determine if you’re eligible to recover long-term disability benefits. The judge’s decision in the matter is final.
