Disability Insurance Appeal Lawyer in Texas

Assisting Individuals in Texas with Filing a Disability Insurance Appeal

People obtain disability insurance coverage in the hopes that they will be compensated should they suffer from a permanent injury or illness that totally prevents them from working. However, this does not always occur, and insurance companies routinely deny their insureds disability benefits when they make a claim. When that happens, you may be able to file an appeal of your disability claim denial.

You should be aware that filing a disability appeal is a multi-step process. If you are considering filing an appeal, a disability insurance appeal lawyer in Texas can assist you in the process.

If you are interested in filing an appeal, the knowledgeable legal team at the Law Offices of J. Price McNamara is ready to assist. Please contact us online today for more information and to schedule a free case evaluation and legal consultation.

First Step in the Appeals Process

The first step in the appeals process is to file an administrative appeal through the insurance company. Insurance companies are required to allow at least one administrative appeal opportunity, and some insurance companies will allow up to two such opportunities.

As part of the administrative appeals process, it is essential that you supplement the file with any additional medical documentation regarding your disability (and your inability to work) that the insurance company needs to know about in order to make its decision. At the federal court level, you will not have the ability to supplement the record. Once your administrative appeal or appeals have been filed, the insurance company will review the decision and decide on your eligibility for disability benefits.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Federal Court Litigation Option

Once you have exhausted all of your insurance company’s administrative remedies, you may be able to file a lawsuit against your insurance company in federal court, if you still do not have the disability benefits that you need.

At the federal court level, you will not have the opportunity to supplement the administrative file with any new medical records or other documentation. Moreover, at the federal level, you will not be entitled to a jury trial. Instead, the presiding judge will decide the outcome of your case and decide on whether or not you are eligible to recover long-term disability benefits.

A knowledgeable disability insurance appeals lawyer in Texas can help you you’re your administrative appeal, and if you are unsuccessful, pursue federal court litigation against your insurance company. Your lawyer will be present with you at all of your legal proceedings and will advocate on your behalf in order to help you pursue the disability benefits that you deserve.
