Dallas Life Insurance Claims Lawyer

Assisting Dallas, Texas Residents with Filing or Appealing a Life Insurance Claim

Many workers decide to take out life insurance policies that are made available to them through their employers. The purpose of a life insurance policy is to ensure that loved ones will not be unduly burdened at the time the insured passes away. Life insurance payouts can be used towards funeral and burial expenses for the insured, as well as to ensure that the beneficiary or beneficiaries are properly compensated.

However, in many cases, insurance companies refuse to honor life insurance claims made by the designated beneficiary. If your insurance company has denied a claim for life insurance benefits, it is essential that you pursue legal assistance as soon as possible. At the Law Offices of J. Price McNamara, our experienced team of Dallas life insurance claims lawyers welcome the opportunity to pursue benefits on your behalf – and to appeal a claim denial, if necessary.

When are Benefits Typically Denied?

There are numerous reasons why a life insurance company may decide not to honor a claim for benefits. In some instances, the insurance company may contend that the insured did not pay all of his or her monthly premiums during the lifetime of the policy, and that consequently, the policy lapsed at some point.

In the alternative, the insurance company might argue that the insured failed to disclose a preexisting medical condition, illness, or injury on the application for insurance benefits. Consequently, the insurance company may conclude that the policy terminated prior to the insured’s death.

Although an insurance company could conceivably deny life insurance benefits in the event of a material misrepresentation of fact by the insured, a minor error or omission on a life insurance policy is not grounds for the insurance company to deny a benefits payout.

Possible Appeal Remedies

If you are the beneficiary under a life insurance policy and the insurance company has denied your claim for benefits, you may have the option of filing an appeal. First, you will need to file an administrative appeal with the insurance company. At this point, you may be able to submit additional documentation, in an attempt to make the insurance company change its mind.

Once you have exhausted all administrative remedies, and if the policy falls within an employer-sponsored plan, you may be able to appeal your claim denial to federal court. An experienced Dallas life insurance claims lawyer can help you file an appeal in your case and will explain all of your legal rights in a way that you can understand.

Our number-one goal is getting you and your family back to financial security as soon as possible.
