When Does ERISA Apply to an Insurance Policy?

The Employee Retirement Income Security Act of 1974, commonly referred to as ERISA, is a federal statute that was enacted in 1974 to ensure that employees receive the insurance benefits that they deserve and to which they are entitled. In recent years, though, the statute has oftentimes had the exact opposite effect. In fact, the statute tends to favor insurance companies and employers, since in federal court (the venue for ERISA cases), juries do not determine the outcome. Instead, a federal judge decides the outcome of any pending ERISA case. 

The ERISA statute typically applies to cases involving insurance benefits that are covered under an employer-sponsor plan. For example, if you receive your health insurance, accidental death insurance, life insurance, and/or disability insurance plans through your employer, the chances are good that the ERISA statute controls the policy, as well as your entitlement to insurance benefits.

Making a Claim for Insurance Benefits under an Insurance Policy

Under most insurance policies, either the insured or the beneficiary can make a claim for benefits upon the happening of one or more occurrences. For example, in the case of long-term disability benefits, the insured may be able to make a claim under the policy if he or she becomes permanently disabled in such a way that working in any capacity becomes impossible. On the other hand, with life insurance policies, the designated beneficiary may be able to make a claim for benefits once the insured passes away.

Even still, insurance companies will oftentimes look for ways to deny individuals a benefits payout. When that happens, you may have several options. First, you may be able to administratively appeal the denial decision directly with your insurance company. If that fails, you may then have the option of filing an appeal in federal court, where a judge will decide your eligibility for benefits.
