Dallas Health Insurance Claims Lawyer

Helping Individuals in Dallas File a Health Insurance Claim or Appeal a Claim Denial

A health insurance claim denial often comes as a bit of a shock. People pay their premiums and expect that coverage will be forthcoming when they are faced with a serious personal injury or illness. Insurance companies, however, are big businesses, and they will do everything possible to try and deny a claim, or at least limit their exposure under an existing insurance policy.

Insurance companies must abide by a duty of good faith and fair dealing with their insureds. This includes timely paying a valid claim for a reasonable amount and not unduly prolonging a claim. When an insurance company does not uphold its end of the bargain, you, the insured, might be able to take legal action against the insurance company, based on a breach of contract theory of recovery. Attorney J. Price McNamara of the Law Offices of J. Price McNamara could assist you with undertaking the necessary legal actions against your insurance company and pursuing a result that is favorable to you. Legitimate Reasons for a Health Insurance Claim Denial

There are several potentially legitimate reasons why a health insurance company might deny your claim. For example, you may not have provided the necessary documentation for the insurance company to be able to properly evaluate your claim in the first place, or you might not have made your claim in a timely manner.

Moreover, the particular injury or illness from which you suffer may not be covered under your insurance policy. There might also have been a clerical or administrative error which resulted in a processing delay. Finally, the insurance company might claim that it did not authorize your medical treatment in advance.

If any of these is the case, your insurance company might have a legitimate reason for denying your health insurance claim. An experienced health insurance claims lawyer in Dallas could review the language of your policy and determine whether there might have been a legitimate reason for the denial. If there was not, your lawyer might be in a position to challenge the claim denial on your behalf.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Bad Faith Reasons for a Health Insurance Claim Denial

Health insurance companies must act in good faith at all times. When they breach that duty of good faith, you might be eligible to take legal action against them. A health insurance company may deny a claim for benefits in bad faith by requiring the insured to submit medical documentation that is irrelevant or unnecessary to the claim presented. The health insurance company might also offer unreasonable compensation to pay the claim.

A health insurer could also act in bad faith by ignoring a validly presented claim altogether.

If a health insurer decides to deny a claim, for whatever reason, the insurer is required to notify the insured of that fact in writing. Moreover, the insurer must expressly state the reasons why the claim is being denied. If the insurance company fails to take any of these measures, it is acting in bad faith, and you might be able to take legal action against the insurance company.
