When it comes time for a policyholder or a designated beneficiary to make a claim under an ERISA policy, there are sometimes complications. For example, the insurance company may decide to deny the claim for one or more reasons. If the insurance company decides to pursue this course of action, it must send you a denial letter stating why the claim is being denied and what you need to do in order to rectify the claim denial.

In many cases, fixing a claim denial may be as simple as attaching more documentation, such as medical documentation, in support of your claim for insurance benefits. This information is usually supplied by way of an administrative appeal, which an insurance company handles internally.

If you are not successful at the administrative level, you may then have the option of pursuing litigation against your insurance company in federal court. Since ERISA is a federal statute that was passed by the United States Congress, the federal district court has jurisdiction over cases that implicate this statute.

You begin federal ERISA litigation by drafting a lawsuit and filing it with the district court. The defendant in this lawsuit is your insurance company since they are the ones from whom you are seeking relief. Once a lawsuit is filed, your insurance company will appoint counsel for legal representation, the parties will engage in discovery, and a hearing will be scheduled before a federal judge. At the hearing, the judge will decide whether or not you are entitled to insurance benefits under your employer-sponsored ERISA policy.
