Dallas Disability Insurance Denial Attorney

Helping Insureds in Dallas, Texas Appeal a Long-Term Disability Denial

If you have suffered or if you’re currently suffering a long-term disability, you may elect to file an application for disability benefits with your insurance company. It is ultimately up to the insurance company to decide whether or not to award you disability benefits, and in the end, you may need to appeal your case to the federal court. If you appeal your case in federal court, a judge will ultimately decide whether or not you are entitled to disability benefits.

Filing a claim and pursuing benefits for long-term disability can be a complicated task. If you are in the process of pursuing these benefits, it is essential that you have an experienced attorney representing you at every stage in your case. A lawyer can assist you throughout the application process and can accompany you to all court proceedings.

Denial Letter from Your Insurance Company

Many individuals are unpleasantly surprised after they file a claim for long-term disability benefits, and the insurance company decides to deny their claim. Insurance companies deny claims for long-term disability benefits for a variety of reasons. In many instances, these denials happen because of insufficient medical documentation. Specifically, the documentation which the insured includes in the application packet must demonstrate that he or she suffers from a long-term illness or injury, and as a result, he or she is unable to work.

The insurance company’s denial letter will include the steps that you need to take in order to correct any deficiencies in your benefits application package. The letter will also set forth various time limits that you must follow in order to administratively appeal your case. If you do not follow these time requirements, it is almost certain that the insurance company will deny your benefits claim again.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Administrative Appeals and Federal Court Appeals

When you file an administrative appeal, you will need to include sufficient documentation to satisfy the legal standard for long-term disability benefits. You must include medical documentation from a healthcare provider that establishes that your injury or illness prevents you from working at any job in any capacity. You must also exhaust all of your insurance company’s administrative appeal options prior to taking legal action and filing a lawsuit against your insurance company in federal court.

If you do choose to file a lawsuit against your insurance company in federal court, you should be aware that a federal judge will decide the outcome of your case – not a jury of your peers. An experienced Dallas disability insurance denial attorney can be present with you during your trial, can make arguments on your behalf, and advocate for you in the courtroom, in an attempt to convince the judge that you are entitled to long-term disability benefits. The final decision will then be left to the presiding judge.
