The standard for obtaining long-term disability benefits is often very high. In fact, in many instances, insurance companies regularly deny first-time applicants their disability benefits. These denials usually occur because the initial filings are incomplete and do not contain sufficient medical documentation to support an award of long-term disability benefits.

In order for an insured to qualify for disability benefits, he or she must demonstrate that there is a long-term injury or illness in existence and that this injury or illness prevents the insured from working at any job – and in any capacity. Denied Benefits

It is not unusual for an insurance company to deny an application for disability benefits. The good news, however, is that the insurance company must afford you with at least one right to appeal a denial decision.

When appealing a denial decision, an insured should first look to the language of the insurance company’s denial letter. That letter will state the time period in which the insured must file an in-house appeal, and it will also articulate a specific reason for the disability benefits denial. In some instances, obtaining approval for disability benefits may be as simple as supplementing the medical documentation in the file. You should know, however, that if you do not supply the additional medical documentation at the in-house level, you will not be able to do so in the future if the matter goes to federal court.

Another option that you may have if you are denied disability benefits is to litigate your case in federal court by filing a lawsuit in that court. However, you must first exhaust all of your administrative options, and your benefits must have been denied again by your insurance company. 

When you litigate your case in the federal court system, the defendant in the case is your insurance company. The final decision about whether or not you are entitled to receive disability benefits is left to a federal judge, and a jury will not decide your case in the federal system. Moreover, in federal court, you will not be able to challenge the insurance company’s denial of disability benefits based upon a claim of bad faith.
