Helping People Like You…

Too much is at stake to guess about the best approach and strategy for fighting your denied insurance claim — years and years of financial security.

After spending years representing insurance companies, we don’t guess. We know their playbook and how they work behind the scenes. Using that knowledge, we’ve developed our own Clear Advantage Process for fighting claims.

It’s personally satisfying to use what I’ve learned as an insurance company insider, now for the good — helping families reverse unfair denials of insurance benefits they paid for, need and deserve.

Understanding ERISA Plans

ERISA plans are unlike traditional insurance plans in that they are employer-sponsored. Rather than contracting with an outside insurance company to provide benefits, the company maintains its own fiduciary, whose responsibility it is to manage funds in order to ensure employee health and welfare issues can be addressed as needed. Although they may take many different forms, all plans must follow rules set forth by the federal Employee Retirement Income Security Act of 1974 (ERISA).

Our number-one goal is getting you and your family back to financial security as soon as possible.

ERISA Protections

Protections for employers may include a combination of programs, including:

  • Life insurance;
  • Short- and long term disability plans;
  • Health insurance;
  • Retirement plans, including profit sharing, ESOP plans, and 401(k) plans.

Who is Eligible for ERISA?

Many companies offer plans to address employee health issues and disability, but not all are ERISA plans. Here are some of the ways to distinguish whether or not ERISA laws govern your benefits:

  • If your employer is a religious or public business, it is not an ERISA plan;
  • If the entity with whom you deal is a plan administrator, it is likely an ERISA plan;
  • If you pay the premiums without the help of your employer, it probably is not an ERISA plan.

Denied Claims

Unfortunately, all too often employee claims are met with resistance. After all, employers are looking to save money, and sometimes it comes at the cost of employee health and welfare. If you face claim denials that seem unreasonable, the experienced ERISA team at The Law Offices of  J. Price McNamara can help. After carefully dissecting your denial of benefits letter, we proceed quickly and efficiently to obtain the benefits you deserve by:

  • Investigating your medical and work history for evidence to support your claim;
  • Compiling the necessary documents to go into battle;
  • Appealing the ERISA denial of benefits;
  • Negotiating with plan administrators to come to a satisfactory outcome on your behalf;
  • Taking the issue to court if necessary.

A Fight Worth Fighting

It can be discouraging to be told you are ineligible for benefits that are desperately needed. Do not give up just because you feel small and insignificant in the face of a powerful employer. You do not have to take on this battle alone. At The Law Offices of  J. Price McNamara, we will take on your opponent and keep at it until achieving the best possible results for you.
